Federal Tipped Employees Regulations
From the IRS's Circular E:
Collecting taxes on tips. You must collect income tax, employee social security tax, and employee Medicare tax on the employee's tips. If an employee reports to you in writing $20 or more of tips in a month, the tips are also subject to FUTA tax.
From the Department of Labor:
Employers may pay employees on a piece-rate basis, as long as they receive at least the equivalent of the required minimum hourly wage rate. Employers of tipped employees (i.e., those who customarily and regularly receive more than $30 a month in tips) may consider such tips as part of their wages, but employers must pay a direct wage of at least $2.13 per hour if they claim a tip credit. They must also meet certain other conditions.
New Hampshire Tipped Employees Regulations
Tipped employees who customarily and regularly earn $30 or more directly from customers must receive a base rate of not less than 45 percent of the minimum wage then in effect. If the employee can show that he or she has not received minimum wage for the pay period, the employer is required to make up the difference
